根据 《劳动合同法》 和国家有关规定, 甲乙双方经平等协商一致,
自愿签订本合同,共同遵守本合同条款: Aording to the "labor
contract law" and the relevant provisions of the state, through
equal consultation between both parties ’ agreement, sign this
contract voluntarily, abide by the terms of this contract
一、劳动合同期限 Term of the Labor Contract
本合同期限类型为 ______期限合同 The type of the contract is

二、工作内容和义务 Job Content and Responsibility
1 、乙方同意根据甲方工作需要 , Aording to Party A’s demand,
在部门,从事 ______(管理、销售、技术、生产、后勤等)工作,并
遵守岗位工作制度与合理的工作安排 (包括但不限于工作内容、 工作
地点)。 Party B agrees to engage in __________

2 、乙方应当按照甲方岗位职责要求,保质保量完成工作任务;

B should finish working task with quality and quantity
guaranteed.
3 、甲方本着“一专多能、一职多岗”的用人原则,可以根据经营
需要及乙方的工作能力调整乙方的工作职务和岗位, 乙方应服从安排。
Based on the principle of “one skill with multiple ability,
one post with multiple work”, and aording to the business demand
and Party B’s petence, Party A may adjust Party B’s duty and
post, while Party B should obey the adjustment.
三、劳动保护和劳动条件 Labor Protection & Labor Condition
1 、甲方根据国家有关安全生产、劳动保护、职业卫生的规定,为
乙方提供必要的工作条件和劳动保护设施,保障乙方的安全与健康;
Aording to the related stipulation of safety manufacture/labor
protection/oupational health from the state, Party A provides
necessary working condition and labor protection facilities,
insuring Party B ’s safety and health.
2 、甲方根据国家有关规定制定工时制度, 乙方确因生产经营需要
延时的, 甲方应当依法安排乙方补休或支付相应的加班费; 若乙方实
行的是级别工资,则在当月的绩效考核中体现; Aording to the
relevant regulations of working hour system ,if Party B needs
to extend the working hours due to the need of production and
operation, party A shall arrange party B pensatory time off or
pay overtime salary in aordance with the law; If party B is
implemented wage levels, the pensation should be reflected in
the performance appraisal for the month.
3 、甲方根据国家有关规定为孕期、产期、哺乳期的女职工提供劳
动保护; Party A should provide protection for women workers in
pregnancy, childbirth, breastfeeding, in aordance with the
relevant provisions of the State.
4 、甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安
全卫生及有关规章制度的告知、 教育和培训。 Party A is responsible
to provide political ideology, professional ethics, business
technology, labor safety and hygiene, and related rules,
education and training for Party B.
四、劳动报酬 Labor remuneration
根据“按劳分配”原则,实行同工同酬,乙方的报酬不得低于当
地最低工资标准。 具体薪酬标准、 支付方式以及支付时间按公司制定
的《薪酬管理制度》 执行。Aording to the principle of distribution,
and equal pay for equal work, remuneration of Party B shall not
be lower than the local minimum wage standard. Specific

五、社会保险 Social Insurance
甲方应按照国家有关社会保险的法律、法规和政策为乙方缴纳基
本养老、基本医疗、失业、工伤、生育保险费用;社会保险费个人缴
纳部分,甲方从乙方工资中代扣代缴。 In aordance with national
laws, regulations and policies relating to social insurance,
Party A shall pay the basic pension, basic medical,
unemployment, work injury and maternity insurance costs, for
the Party B; social insurance premiums paid by individuals part
is withhold wages from Party B.
六、劳动纪律和规章制度 Labor discipline and regulations
1 、甲方依法制定的劳动纪律和规章制度, 乙方有义务遵守; Labor
discipline and regulations legally stipulated by party A, party
B shall have the duty to abide by it.
2 、签订本合同前,甲方已对乙方进行了劳动纪律、操作规程、管
理制度等相应的培训; Before signing this contract, Party A has
to provide party B the labor discipline, operating procedures,
management system and the corresponding training
3 、乙方应当遵守甲方的工作操作规程,服从工作安排; Party B
shall abide by the working procedures, obey the work
arrangement of party A.
4 、乙方违反劳动纪律或规章制度, 甲方有权按本单位的规章制度,
给予纪律处分,直至解除本合同。 If Party B violates labor
discipline or regulations, Party A is entitled by the rules of
the unit to give Party A disciplinary action, up to terminate
this contract.
七、劳动合同的变更 The change of labor contract
订立本合同所依据的客观情况发生重大变化,致使本合同无法继
续履行的,经双方协商同意,予以变更劳动合同相关内容。 If the
objective situation this contract based on, changes
significantly, to result the contract unable to perform, by
mutual consent, related content in labor contracts shall be
changed.
八、劳动合同的解除 The remove of labor contract
(一)双方协商一致,劳动合同可以解除。 The two party may
terminate the labor contract with mutual agreement.
(二)乙方有下列情形之一的,甲方可以即行解除劳动合同: Of
any of the following circumstances, party A may immediately
terminate the labor contract.
1 、在试用期内被证明不符合录用条件的; Been proven not to meet
the conditions of employment during the trial period.
2 、采取欺诈手段订立本合同的; Adopted fraudulent means to
enter into this contract.
3 、严重违反劳动纪律或规章制度给甲方造成重大损害的;
Seriously violated labor discipline or regulations to cause
significant harm to the Party A.
4 、严重失职、营私舞弊,或泄露甲方商业秘密,给甲方利益造成
重大损失的; Gross negligence, malpractice, or disclosure of
trade secrets Party A, to cause heavy losses to the interests
of the Party A.
5 、乙方同时与其他用人单位建立劳动关系, 对完成本单位的工作
任务造成严重影响, 或者经用人单位提出, 拒不改正的; Party A built
labor relationships with other unit, to cause a serious impact
on the pletion of the tasks of the unit, or refused to correct
the rules made by the employer
6 、被依法追究刑事责任的。 Be investigated for criminal
responsibility aording to law
(三) 有下列情形之一的, 甲方可以提前 30 日以书面形式通知乙
方解除劳动合同: Of the following circumstances, Party A can
give notice to inform Party B to terminate the labor contract
ahead of 30 days.
1 、乙方不能胜任工作, 经培训或调整工作岗位仍不能胜任工作的;
Party B is not petent for work, after training or adjustment
of jobs.
2 、乙方患病或者非因工负伤,医疗期满后,不能从事原工作,也
不能从事甲方另行安排工作的; Party B was ill or injured due to
non-work relation, after pletion of medical, Part A is not
petent for his original work, or alternative arranged jobs.
3 、劳动合同订立时所依据的客观情况发生重大变化, 致使劳动合
同无法履行,双方协商不能就变更劳动合同达成协议的。 If the
objective situation this contract based on, changes
significantly, to result the contract unable to perform, mutual
consent can not be reached, in change of this labor contracts.
(四)有下列情形之一的,甲方可以提前 30 日通知工会,经工会
同意后,与乙方解除劳动合同: Of the following circumstances,
Party A can give notice ahead of 30 days, to inform the Labor
Union, after agreement, Party A may terminate the labor
contract.
1 、甲方依照企业破产法规定进行重整的; Party A restructured
pursuant to the Enterprise Bankruptcy Law
2 、甲方生产经营发生严重困难的; Production and business
operation of Party A met serious difficulties.
3 、甲方转产、重大技术革新或者经营方式调整,经变更劳动合同
后,仍需裁减人员的; production, technological innovation or
business method of Party A adjusted, after the change of labor
contracts, still needed to reduce staff.
4 、其他因劳动合同订立时依据的客观经济情况发生重大变化, 致
使劳动合同无法履行的。 If other objective situation this
contract based on, changes significantly, to result the
contract unable to perform.
(五) 乙方有下列情形之一的, 甲方不得解除劳动合同: Of any of
the following circumstances, party A can not terminate the
labor contract.
1 、在本单位患职业病或者因工负伤并被确认丧失或者部分丧失劳
动能力的; Injured due to oupational disease or work-related
reasons, and was confirmed as having lost or partially lost the
ability to work.
2 、患病或者非因工负伤,在规定的医疗期内的; Illness or
non-work related injury within the
prescribed period of medical treatment.
3 、女职工在孕期、 产期、 哺乳期的;women workers in pregnancy,
childbirth, breastfeeding.
4 、在本单位连续工作满十五年,且距法定退休年龄不足五年的;
Worked continuously for 15 years and less than five years away
from his legal retirement age In this unit.
5 、法律、行政法规规定的其他情形。 Other circumstances
stipulated by laws and administrative regulations.
(六)乙方解除劳动合同, 应当提前三十日 (试用期内提前三日)
以书面形式通知甲方, 甲方在乙方完成业务以及清理完债权债务的情
况下,可以解除劳动合同。 Of the following circumstances, Party
B shall give notice to inform Party A to terminate the labor
contract ahead of 30 days after cleaning up the credits and
debts.
(七)有下列情形之一的,乙方可以通知甲方解除劳动合同: Of
the following circumstances, Party B may give notice to inform
Party A to terminate the labor contract.
1 、在试用期内的; During the trial period.
2 、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;
Party A forced Party A to labor by violence, threat or illegal
restriction of personal freedom.
3 、甲方未按劳动合同约定提供劳动保护和劳动条件的; Party A
failed to provide the labor protection and labor conditions.
4 、甲方未按照劳动合同的约定支付工资报酬的; Party A failed
to pay wages in aordance with the labor contract.
5 、法律、行政法规规定劳动者可以解除劳动合同的其他情形。
Other circumstances stipulated by laws, administrative
regulations by which employee may terminate the labor contract.
九、劳动合同的终止 Termination of labor contracts
(一)有下列情形之一的,劳动合同即行终止: Of any of the
following circumstances, the labor contract may be immediately
terminate
1 、劳动合同期满的; The labor contract expired.
2 、劳动者开始依法享受养老保险待遇的; Workers began to enjoy
endowment insurance treatment lawfully.
3 、劳动者死亡,或者被 __ 宣告死亡或者宣告失踪的; Laborer
died, or was declared dead or missing by the people's court.
4 、甲方被依法宣告破产的; Party A was declared bankrupt by
the people's court
5 、甲方被吊销营业执照、责令关闭、撤销或者提前解散的;
Business license of Party B was revoked, ordered to close,
cancellation or early dissolution of.
6 、法律、行政法规规定的其他情形。 Other circumstances
stipulated by laws, administrative regulations.
(二)乙方应在劳动合同期满前 30 天通知甲方,甲方同意续订,
乙方应及时申请办理续订手续; 若甲方不同意续订, 到期即办理终止
合同手续。 乙方未办理终止合同手续而离职的, 甲方保留追究其法律
责任的权利。 Party B shall give notice to inform Party A to renew
the labor contract ahead of 30 days. If Party A disagreed to
new a lease, the labor contract would go expire. If Party B left
without the termination procedures, Party A would retain right
to pursue its legal responsibility.

的原因, 本公司可在必要的情况下对该员工的职务和工作职责进行适
当调整。
2.1 The trial period will start on the date of signature of
this CONTRACT. The duration of the trial
period is three (3) months. During the trial period the
EMPLOYEE will be bound by all articles of this contract.
试用期自本合同签署之日起开始,时间为三个月。在试用期间,
该员工受本合同全部条款所约束。
2.2 After the specified trial period and if no notice of
termination is given the EMPLOYEE
automatically bees employed under the terms and conditions
of this CONTRACT.
在约定的试用期内, 若该员工没有收到关于解除劳动关系 __ ,在
试用期满后, 该员工自动转为本公司正式员工, 执行本合同规定的条
款。
3.1
3.2 The duration of this CONTRACT is twenty-sixth (26)
months. 本合同期限为 26 个月。 This CONTRACT maybe extended
upon agreement of both PARTIES. An extension to this
CONTRACT shall e into force only after a written agreement
has been signed by both PARTIES.
本合同经合同双方同意后可以续签。只有在合同双方签署书面协
议后,续签的合同方能生效。
4.1 The PANY shall define its own salary policy in aordance
with regulations stipulated by the state and municipal
government. The PANY shall ensure that the monthly salary of
the EMPLOYEE is not less than the minimum pay standard set by
the local government.
本公司将依照中华人民 __ 和北京市有关政策法规制定本公司的
员工工资标准。 本公司保证该员工的月工资将不低于当地政府规定的
最低工资。
4.2 The EMPLOYEE will receive a gross 口 monthly or 口 annual
salary of XXX renminbi (RMBXXX) and increase thereafter the
basis of the staff performance, the economic development of the
PANY
and aording to the salary policy of the PANY approved by the
Board of Directors of the PANY, and etc.
该员工税前工资将为 口每月 或 口每年 XXX元人民币, 今后将按
照该员工的工作表现、 本公司的经济效益以及由本公司制定并经董事
会批准的工资标准每年递增。
4.3 Such salary shall be transferred to the bank aount
designated by the EMPLOYEE between the third and fifth day of
each month.
上述工资将于每月 3 号至 5 号期间汇入该员工所指定的银行账户。
5.1 At the full discretion of the Chief Executive Officer
and based upon his/her general attitude and
the result of his/her work and fulfilment of his/her
objectives detailed with his/her manager and at the beginning
of each calendar year the EMPLOYEE will be entitled to an annual
bonus not exceeding one (1) month of salary and shall be paid
to the EMPLOYEE for each full calendar year which the EMPLOYEE
works for the PANY in two (2) instalments the following year.
经本公司首席执行官同意, 并且根据该员工的工作态度、 工作成果及
其上级主管规定之工作目标的完成状况, 该员工将有权在每个公历年
初享受年终奖金(奖金总额不超过该员工的月工资)。员工为公司工

6.1 The EMPLOYEE shall pay individual ine tax in aordance

shall withhold such amount and pay it to the petent tax bureau.

司将为该员工代扣代徼个人所得税, 并将应纳税款上交相应税务机关。

Chapter I General Provisions
Article 1 This Law is formulated for the purposes of
improving the labor contractual system, clarifying the rights
and obligations of both parties of labor contracts, protecting
the legitimate rights and interests of employees, and
establishing and developing a harmonious and stable employment
relationship.

第一章 总则
第一条 【立法宗旨】为了完善劳动合同制度,明确劳动合同双方
当事人的权利和义务, 保护劳动者的合法权益, 构建和发展和谐稳定
的劳动关系,制定本法。
第二条 【适用范围】中华人民 __ 境内的企业、个体经济组织、
民办非企业单位等组织(以下称用人单位)与劳动者建立劳动关系,
订立、履行、变

Article 3 The principle of lawfulness, fairness, equality,
free will, negotiation for agreement and good faith shall be
observed in the formation of a labor contract.
A labor contract concluded aording to the law shall have a
binding force. The employer and the employee shall perform the
obligations as stipulated in the labor contract.
Article 4 An employer shall establish a sound system of
employment rules so as to ensure that its employees enjoy the
labor rights and perform the employment obligations.
Where an employer formulates, amends or decides rules or
important events concerning the remuneration, working time,
break, vacation, work safety and sanitation, insurance and
welfare, training of employees, labor discipline, or
management of production quota, which are directly related to
the interests of the employees, such rules or important events
shall be discussed at the meeting of employees' representatives
or the general meeting of all employees, and the employer shall
also put forward proposals and opinions to the employees and
negotiate with the labor union or the employees'
representatives on a equal basis to reach agreements on these
rules or events.
During the process of execution of a rule or decision about
an important event, if the labor union or the employees deems
it improper, they may require the employer to amend or improve
it through negotiations.
The employer shall make an announcement of the rules and
important events which are directly related to the interests
of the employees or inform the employees of these rules or
events.
Article 5 The labor administrative department of the
people's government at the county level or above shall,
together with the labor union and the representatives of the
enterprise, establish a sound three-party mechanism to

订立、履行、变更、解除或者终止劳动合同,依照本法执行。
第三条 【基本原则】订立劳动合同,应当遵循合法、公平、平等
自愿、协商一致、诚实信用的原则。
依法订立的劳动合同具有约束力,用人单位与劳动者应当履行劳
动合同约定的义务。
第四条 【规章制度】 用人单位应当依法建立和完善劳动规章制度,
保障劳动者享有劳动权利、履行劳动义务。
用人单位在制定、修改或者决定有关劳动报酬、工作时间、休息
休假、劳动安全卫生、保险福利、职工培训、劳动纪律以及劳动定额
管理等直接涉及劳动者切身利益的规章制度或者重大事项时, 应当经
职工 __ 或者全体职工讨论,提出方案和意见,与工会或者职工代表
平等协商确定。
在规章制度和重大事项决定实施过程中,工会或者职工认为不适
当的,有权向用人单位提出,通过协商予以修改完善。
用人单位应当将直接涉及劳动者切身利益的规章制度和重大事项
决定公示,或者告知劳动者。
第五条 【协调劳动关系三方机制】 县级以上人民政府劳动行政部
门会同工会和企业方面代表, 建立健全协调劳动关系三方机制, 共同
研究解决有关劳动关系的重大问题。

第六条 【集体协商机制】工会应当帮助、指导劳动者与用人单位
依法订立和履行劳动合同, 并与用人单位建立集体协商机制, 维护劳
动者的合法权益。
Chapter II Formation of labor contracts
第二章 劳动合同的订立
Article 7 An employer establishes an employment
relationship with an employee from the date when the employer
puts the employee to work. The employer shall prepare a roster
of employees for inspection.
Article 8 When an employer hires an employee, it shall
faithfully inform him of the work contents, conditions and
location, oupational harm, work safety state,
remuneration, and other information which the employee
requires to be informed. The employer has the right to know
the basic information of the employer which is directly related
to the labor contract and the employee shall faithfully provide
such information.
Article 9 When an employer hires an employee, it shall not
detain his identity card or other certificates, nor require him
to provide a guaranty or collect money or property from him
under any other excuse.
Article 10 A written labor contract shall be concluded in
the establishment of an employment relationship.
Where an employment relationship has already been
established with an employee but no written labor contract has
been entered simultaneously, a written labor contract shall be
concluded within one month from the date when the employee
begins to work.
Where an employer and an employee conclude a labor contract
prior to the employment, the employment relationship is
established from the date when the employee begins to work.
Article 11 Where an employer fails to conclude a written
labor contract when the employer put his employee to work,
第七条 【劳动关系的建立】 用人单位自用工之日起即与劳动者建
立劳动关系。用人单位应当建立职工名册备查。
第八条 【用人单位的告知义务和劳动者的说明义务】 用人单位招
用劳动者时,应当如实告知劳动者工作内容、工作条件、工作地点、
职业危害、安全生产状况、 劳动报酬,以及劳动者要求了解的其他情
况;用人单位有权了解劳动者与劳动合同直接相关的
基本情况,劳动者应当如实说明。第九条 【用人单位不得扣押劳
动者证件和要求提供担保】 用人单位招用劳动者, 不得扣押劳动者的
居民 __ 和其他证件,不得要求劳动者提供担保或者以其他名义向劳
动者收取财物。
第十条 【订立书面劳动合同】建立劳动关系,应当订立书面劳动
合同。
已建立劳动关系,未同时订立书面劳动合同的,应当自用工之日
起一个月内订立书面劳动合同。 用人单位与劳动者在用工前订立劳动
合同的,劳动关系自用工之日起建立。
第十一条 【未订立书面劳动合同时劳动报酬不明确的解决】 用人
单位未在用工的同时订立书面劳动
if the remuneration stipulated between the employer and the
employee is not clear, the remuneration to the new employee
shall conform to the provisions of the collective contract. If
there is no collective contract or if there is no such
stipulation in the collective contract, the principle of equal
pay for equal work shall be observed.
Article 12 labor contracts are classified into fix-term
labor contracts, labor contracts without a fixed term, and the
labor contracts that set the pletion of specific tasks as the
term to end contracts.
Article 13 A fixed-term labor contract refers to a labor
contract in which the employer and the employee stipulate the
time of termination of the contract.
The employer and the employee may conclude a fixed-term
labor contract upon negotiation.
Article 14 A labor contract without a fixed term refers to
a labor contract in which the employer and the employee
stipulate no certain time to end the contract.
An employer and an employee may, through negotiations,
conclude a labor contract without a fixed term. Under any of
the following circumstances, if the employee proposes or agrees
to renew or conclude a labor contract, a labor contract without
a fixed term shall be concluded unless the employee proposes
to conclude a fixed-term labor contract: 1. The employee has
already worked for the employer for 10 full years
consecutively;
2. When the employer initially adopts the labor contract
system or when a state-owned enterprise re-concludes the labor
contract due to restructuring, the employee has already worked
for this employer for 10 full years consecutively and he attains
to the age which is less than 10 years up to the statutory
retirement age; or
3. The labor contract is to be renewed after two fixed-term
labor contracts have been concluded consecutively, and the
employee is not under any of the circumstances as mentioned in
Article 39 and Paragraphs (1) and (2) of Article 40 of this Law.
If the employer fails to sign a written labor contract with
an employee after the lapse of one full year from the date when
the employee begins to work, it shall be deemed that the
employer and the employee have concluded a labor contract
without a fixed term.

规定的,实行同工同酬。
第十二条 【劳动合同的种类】劳动合同分为固定期限劳动合同、
无固定期限劳动合同和以完成一定 工作任务为期限的劳动合同。
第十三条 【固定期限劳动合同】固定期限劳动合同,是指用人单
位与劳动者约定合同终止时间的劳动合同。
用人单位与劳动者协商一致,可以订立固定期限劳动合同。
第十四条 【无固定期限劳动合同】无固定期限劳动合同,是指用
人单位与劳动者约定无确定终止时间的劳动合同。
用人单位与劳动者协商一致,可以订立无固定期限劳动合同。有
下列情形之一,劳动者提出或者同意续订、订立劳动合同的,除劳动
者提出订立固定期限劳动合同外, 应当订立无固定期限劳动合同: (一)
劳动者在该用人单位连续工作满十年的; (二)用人单位初次实行劳
动合同制度或者国有企业改制重新订立劳动合同时, 劳动者在该用人
单位连续工作满十年且距法定退休年龄不足十年的; (三)连续订立
二次固定期限劳动合同, 且劳动者没有本法第三十九条和第四十条第
一项、第二项规定的情形,续订劳动合同的。
用人单位自用工之日起满一年不与劳动者订立书面劳动合同的,
视为用人单位与劳动者已订立无固定期限劳动合同。
Article 15 A labor contract that sets the pletion of a
specific task as the term to end the contract refers to the labor
contract in which the employer and the employee stipulate that
the time period of the contract shall be based on the pletion
of a specific task.
An employer and an employee may, upon negotiation, conclude
a labor contract that sets the pletion of a specific task to
end the contract.
Article 16 A labor contract shall be agreed with by the
employer and the employee and shall e into effect after the
employer and the employee affix their signatures or seals to
the labor contract.
The employer and the employee shall each hold one copy of
the labor contract.
Article 17 A labor contract shall include the following
clauses:
1. The employer's name, domicile, legal representative, or
major person-in-charge;
2. The employee's name, domicile, identity card number, or
other valid identity certificate number; 3. The time limit for
the labor contract; 4. The job descriptions and work locations;
5. The work hours, break time, and vocations; 6. The
remunerations; 7. The social security;
8. The employment protection, work conditions, and
protection against and prevention of oupational harm; and
9. Other items that shall be included in the labor contract
under any laws or regulations.
Apart from the essential clauses as prescribed in the
preceding paragraph, the employer and the employee may, in the
labor contract, stipulate the probation time period, training,
confidentiality, supplementary insurances, welfares and
benefits, and other items.
Article 18 If remunerations, work conditions, and other
criterions are not expressly stipulated in a labor contract and
a dispute is triggered, the employer and the employee may
re-negotiate the contract. If no agreement is reached through
negotiations, the provisions of the collective contract shall
be followed. If there is no collective contract or if there is
no such stipulation about the remuneration, the principle of
equal pay for equal work shall be observed. If
第十五条 【以完成一定工作任务为期限的劳动合同】 以完成一定
工作任务为期限的劳动合同, 是指用人单位与劳动者约定以某项工作
的完成为合同期限的劳动合同。
用人单位与劳动者协商一致,可以订立以完成一定工作任务为期
限的劳动合同。
第十六条 【劳动合同的生效】 劳动合同由用人单位与劳动者协商
一致,并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。
劳动合同文本由用人单位和劳动者各执一份。
第十七条 【劳动合同的内容】劳动合同应当具备以下条款:
(一)用人单位的名称、住所和法定代表人或者主要负责人;
(二)劳动者的姓名、住址和居民 __ 或者其他有效 __ 件号码;
(三)劳动合同期限;(四)工作内容和工作地点;(五)工作时间
和休息休假;(六)劳动报酬;(七)社会保险;
(八)劳动保护、劳动条件和职业危害防护;(九)法律、法规
规定应当纳入劳动合同的其他事项。
劳动合同除前款规定的必备条款外,用人单位与劳动者可以约定
试用期、培训、保守秘密、补充保险和福利待遇等其他事项。
第十八条 【劳动合同对劳动报酬和劳动条件约定不明确的解决】
劳动合同对劳动报酬和劳动条件等标准约定不明确, 引发争议的, 用
人单位与劳动者可
以重新协商;协商不成的,适用集体合同规定;没有集体合同或
者集体合同未规定劳动报酬的, 实行同工同酬; 没有集体合同或者集
体合同未规定劳动条件等标准的,适用国家有关规定。
